I agree with CaptchaThis. Â Since they changed the law giving pedestrians the "right-of-way," there has been an increase in pedestrian deaths. Â Just because pedestrian's have the right of way, doesn't me they shouldn't use common sense and consider their options. Â I was driving through Coos Bay headed north down by the waterfront and all I could see was a dog with his head stuck out in traffic - when I stopped, there was a man hidden behind his motor home. Â Evaluate the scene and if you are wearing dark clothing, evaluate it even more. Â I really believe the law giving pedestrians the right of way should be re-evaluated. Â Too many deaths.
All too often, there are pedestrians wearing dark/black clothes that make them nearly impossible to see at night. There are also pedestrians who don't stop and evaluate the oncoming traffic; they simply step out into the street as though the mere fact that they have the right of way is all that matters. Your rights aren't an invisible force-field that can keep a vehicle from hitting you. Pedestrians have to take some responsibility for their own safety. That being said, I truly hope this man makes a fast and complete recovery.
