Man accused of rape now a free man
COQUILLE, Ore.-- A man accused of raping a girl at Southwestern Oregon Community College last fall is now a free man.
According the Coos County Court Clerk's office, the Coos County District Attorney will not file any new charges against Cody Dornbirer, nor will he re-try Dornbirer on the charge of unlawful sexual penetration.
Earlier this week, a jury found Dornbirer not guilty of rape, kidnapping and sexual abuse, but it was stuck on a verdict surrounding the lesser charge of unlawful sexual penetration. The judge then declared a mistrial on the single charge.
The district attorney had two to three days to make a decision on the lesser charge or to file any new charges.
There is no word yet on how the jury and district attorney's decisions will impact a $5 million lawsuit against SWOCC in which the victim has claimed the college did not do enough to protect her.
