Horath's attorney challenges basis of death penalty

COQUILLE, Ore. -The man accused of murdering his sister-in-law in Coquille in last month, appeared in a Coos County Courtroom this Monday morning, for his first hearing with an attorney.

Patrick Lee Horath appeared before Judge Michael Gillespie with his attorney by his side. Horath is accused of murdering his sister-in-law, Jayme Sue Austin in November.

Members of Austin's family, including her mother, were in the courtroom Monday, watching the court proceedings.

Last month, Horath was indicted by a Grand Jury on two counts of Aggravated Murder, three counts of Murder and one count of Sexual Abuse in the first degree.

Horath's attorney filed five motions, including two that challenge the basis of the death penalty in this case. His attorney also entered a not guilty plea on behalf of Horath.

The Coos County District Attorney's Office has until January 29 to file a response to the motions filed. Horath's next court appearance will be on February 12.
