Ore. bill would boost fines for drivers on phones

SALEM, Ore. (AP) — The maximum fine for motorists caught talking on their cellphones or texting while driving would increase from $250 to $1,000 under a bill that is being considered by the Oregon Legislature, a move intended to make distracted driving a more serious crime.
The Senate Judiciary Committee on Tuesday approved the bill proposed by Senate President Peter Courtney, D-Salem, with two members dissenting.
Albany police Officer Robert Hayes, speaking for the Oregon Association of Chiefs of Police, said there are simply not enough officers to always enforce the law. He told the committee that he often passes drivers on their cellphones as he is responding to a more pressing call.
"If there is no fear of getting a citation, there is no fear of committing the violation," Hayes said.
The current law that went into effect in January 2010 prohibits motorists from texting or talking on their cellphones while driving. Drivers are permitted to use hand-free accessories to talk on the phone, but texting is illegal in any circumstance.
Courtney said he hopes to change the way Oregonians think about texting and talking on the phone while driving.
"If it was my way, we would treat distracted driving the same way we treat drinking and driving in this state," Courtney told the Associated Press. "And I think one day we will."
Sen. Betsy Close, R-Albany, who voted against the bill, said she's worried the fines are too steep — considering many of the violators are young people.
"My concern is that the maximum fine is high, and that we have a law on the books already," she said.
The number of motorists cited for violating the ban increased since the law went into effect in 2010. Between 2010 and 2012, state troopers issued a total of 4,586 citations and 6,752 warnings, according to police statistics. In 2012, state police issued 2,151 citations, more than twice as many as in 2010 when police issued 1,012 citations.
In 2011, the Legislature closed a loophole that allowed drivers to talk on hand-held cellphones for work-related purposes. Now, the exemption is limited to a handful of professionals.
Sen. Jeff Kruse, a Roseburg Republican who opposed the measure, said he would prefer if the bill applied to all forms of distracted driving, including eating or putting on makeup.
"If we're going to pass a bill like this, I'd rather it be more all-encompassing than just focusing on the cellphone," he said.
The bill would allot approximately $123,000 to the Oregon Department of Transportation to put up signs notifying drivers that texting and talking on the phone is illegal.
Rep. Carolyn Tomei, D-Milwaukie, introduced a similar bill in the House that would set the maximum fine even higher, at $2,000.

I agree with the steeper fines. Just today, my husband and I were out running some errands. We counted several motorists talking on their cell phones and using hand jesters. Seriously people, it is not worth your life or the lives of others!!! GET OFF THE PHONE OR PULL OVER!!!
Make the fines steeper! Maybe then people will get it. I'm tired of having to watch out for those who arn't paying attention to the road.

I am behind the fine if private citizens can pull over and issue citations to the cops that are talking on their cells while driving or reading and typing on their in cat laptops while they are driving. Passed two today that were way more into their laptops than the road.......
I say let them hit me...........I be ready for him. He will pay dearly...........trust that.
I know it is a pain to be at a light and someone on the phone isn't paying attention.

I hope it passes. I'm a truck driver and if caught on the phone without my hands free device it's a $2250 fine to me and $12,000 to my company.
I seen a local Sheriff, still in his uniform, driving his personal car with a toddler in the back seat, TEXTING and driving through Coos Bay........not cool.
"Taking our rights away?" How about those idiots taking your life away? Or you taking someone else's life away? Everyone has rights but your rights don't supersede mine or anyone else's. We ALL have the right to get from Point A to Point B without some distracted idiot plowing into us from front, side, or rear. You have every right to text on your phone as long as you aren't in your vehicle, turning it into a guided missile, aimed at us unsuspecting targets. Most people can't even text while walking...I sure as HELL don't want them texting while driving!
What is the difference with talking on your phone while driving and eating a subway sandwich while driving? I understand the texting issue, not arguing that at all....but the concentration is broken while eating with one hand while driving, just as it is answering a phone and talking with one hand while driving.......or women applying mascara while driving.....lets start fining all of it......because when your concentration is broken on any of these, a wreck could happen or someone could get hit........just sayin
It is really about time they enforce the law!!! I have seen people actually driving and taking pictures with their cell phones... Time to give out bonuses to the officers that do enforce this law!!!
How would you feel if someone hit and injured your child or husband because they were on there phone or texting. I'm glad we have these laws against using your cell phone without a hands free device...My opinion the fines should be higher and include jail time! Dont use your phone and you wont drain your wallet! simple as that!

ya know what, every time i am out driving .. EVERYONE is talking on their cell while driving.. some have even stopped in the road with there phone to do what ever.. where are the cops?????????? it really is pissing me off..
Talking and texting is deadly but raising fines won't help if we don't enforce the laws we have!
